The relevant question is whether the opponents complied with the 
disclosure obligations imposed by the SO.  If the SO required alerts and 
convention cards (as most do), and those were absent, there is a L21B, 
75A, or 40B problem.  If the opponents provided all the disclosure 
required, and "you" failed to ask questions, it's "your" problem (L21A).

There's no way to rule on a specific case without knowing the 
regulations that applied.
