I have some sympathy with Karel's proposal, but:

This is totally wrong! We are not molly-coddling! We are ruling 
against them despite their explanation conforming to the CC.

Please don't forget also, Karel, that while the lawbook says we should 
rule MI if the explanation does not conform to the CC, the lawbook is 
silent about the reverse.
