There is nothing here to suggest that anyone did anything improper or  
illegal.  (a) East is always entitled to decide that his 12-HCP hand  
isn't worth more than a weak 2-bid and treat it accordingly,  
providing his partner doesn't have a reason to expect him to have  
done so.  (b) It is standard practice to open "overweight" weak 2- 
bids in 3rd/4th seat on any hand that can't visualize a game opposite  
a passed hand.  WTP?
