I don't agree with the hint.  A deposit should only be retained if the 
appellants should have known they did not have a case.  If you would have a 
case against experts but not against bunnies or vice versa, it is not your 
responsibility to determine the caliber of the opponents.  (And there are 
many pro-am partnerships in which West is an expert and East a bunny.)
