It amounts to the same thing. Your LHO opens 1C, not alerted.
Partner suddenly calls the TD.
- What?
- 1C should have been alerted.

- So what is it?
- 1C shows 2+C.
- OK, thank you.
Now partner bids 1S.
A dead man would wake up and realize that partner's 1S
bid is artificial.
The fact that ACBL made this their official rule is beyond
me but if they want make it legal to transmit and use
UI after opponents' infraction then hey, - not my monkeys,
not my circus.
