In the 1997 Laws, I think this is pretty clearly UI, by Law 16C2,
since the HK is a withdrawn play.  I don't see any reason why 16C2
wouldn't apply---is there one?  But West is still allowed to play
partner for the HK if it's the only way to beat the contract, e.g.

I haven't finished reading the new Laws, so I can't answer that part.
