Where did either of you find those rules?  Something like them was once 
in effect in the ACBL, but it was repealed long ago.  As far as I can 
tell, the ACBL's present convention charts are valid whether or not 
opponents have made an insufficient bid.  And as David indicates, 
agreements that are not conventions (nor light initial actions) cannot 
be regulated.

Again, where did you find such a rule?  It seems astonishing to allow OS 
more freedom than NOS.
